How to Avoid Criticism: Call it "Bashing"

And a hearty welcome to Atrios's crowd; pity your fearless leader can't link to me without slipping in a puerile epithet, but whatever -- I'll take the traffic anyway I can get it, since being blacklisted by the Big Boys of Blogging... And you bet your ass I have "rage" issues when it comes to that. Asshats.


I am so fucking sick and tired of people at MLW and elsewhere whining about the "DKos bashing" that supposedly goes on here at MLW.

Please take note: If it's not on the Front Page, it's not MLW; it's a member of MLW, using her right to post whatever the fuck she wants to post. If it IS on the Front Page, there is probably a goddamned good reason for it -- and that reason is NOT to get our jollies by gleefully highlighting the latest nonsense that passes for management a DKos. Generally, it's valid criticism -- and when it's not criticism, it's analysis.

Honestly, what do you expect people to do? IGNORE a huge story about bloggers and the FEC?

The persons who post negative commentary about DKos and its proprietor have variously legitimate and illegitimate rationale for that commentary. It is hardly up to ME to determine whether their grievances are valid or not -- but I CAN say that my OWN grievances are VERY valid.

Why should I shut up about it? Why should people constantly be subjected to the admonition to cease "DKos bashing" when in actuality it is not "bashing" at all, but simple criticism, the sort to which everyone ELSE is subjected on a daily basis? Why is DKos supposed to be exempt from criticism and analysis, ESPECIALLY when DKos is the goddamned Topic DuJour everywhere ELSE on the internet, per this FEC thing?

This baffles me.

AND, considering the beating MLW takes on an HOURLY basis over there -- with NO subsequent admonitions from ANYONE to stop "MLW BASHING" -- I am flabbergasted to constantly be subjected to this incessant call for a moratorium on "DKos Bashing."

Let us please FACE FACTS:

Dkos is the 800-pound gorilla of political blogging. It is a NATURAL subject of discussion, therefore, on OTHER blogs. And when those discussions turn negative or ugly, the question one OUGHT to ask oneself is not, "Why are they all picking on DKos?" but "Why are they all picking on DKos?"

Smoke... fire. Oldest goddamned corollary in the book. THOUSANDS of people have MAJOR problems with Moulitsas, his blog, his blog's membership and their behaviour -- WHY?

Jealousy? Oh, sure. We're all JEALOUS. That MUST be the answer.

It couldn't POSSIBLY be that the aforementioned targets of the perennial and ever-INCREASING criticism and anger DESERVE it, could it? Nooooo. Gosh, no. We're all just a bunch of bullies picking on the hero of the internet?

PLEASE consider the FACTS: Markos Moulitsas's OWN BEHAVIOUR has wrought this "DKos bashing." He has offended, injured and otherwise FUCKED WITH too goddamned many people, and the chickens are coming home in fucking DROVES.

As for the FEC thing, I haven't the slightest idea what to say about it. I do know this:

DKos has raised hundreds of thousands of dollars through ActBlue for various candidates -- and whenever ANYONE makes a contribution to ActBlue VIA DKOS, Markos Moulitsas takes a percentage.



CORRECTION: I DON'T KNOW if Moulitsas gets a cut of the "tips" that people leave for ActBlue OR from the donations. In fact, I don't know DICK about any of it. And therein lies the rub of the criticism: nobody knows WHAT the fuck goes on over there, financially. I don't know if it should be legally required or not: I DO know it is ETHICAL to be transparent, and FISHY AS HELL NOT to be.



Do the fucking math. Anyone who thinks this man has made his fortune on ADVERTISING is beyond naive. The percentage he MIGHT HAVE taken off the top of ActBlue contributions via DKos ALONE may well have made him rich. And good for him. THAT'S not the fucking complaint. It's the SECRECY.

Every day, this guy reminds me more and more of George W. fucking Bush.

And I won't even delve into my own personal theories about financial backing from "independent" sources whose existence or identity he has absolutely NO OBLIGATION to disclose. None.

And why would he? It's all worked so WELL till now.

I disclose everything here at MLW concerning my finances -- the donations and the ad revenue -- precisely because I believe in transparency. If anyone wishes to know ANYTHING about the finances of MLW, they are welcome to it -- I post it from time to time, and am, beginning to think I ought to do it quarterly, like a real business, even though my "business" is really just a piddling blog whose income comes mostly from $5 and $10 donations made on a monthly basis by fewer than a score of people, and the occasional fundraising plea when things get tight.

TRANSPARENCY would solve EVERYTHING  -- why is DKos so reluctant to BE transparent?

And I do *hate* doing surveys. But I did it to assuage my guilt for not really having much content to offer lately, here or anywhere else. And as far as the whole  DKos thing, I have a lot of thoughts, but none that I feel up to writing. I spend a lot of time thinking about the standard way that people interact with those who are different from them. Frankly, it's just getting me down. Every now and then I think I've got something worthwhile to say about the big picture, the "ultimate answer to life, the universe, and everything", as it were...but then I think better of it.

Besides, I really need to spend that time trying to generate income.

I think I'm whining again...sorry.

Will be going to water aerobics in about an hour. That usually helps some.

Lately hardly a day goes by on this site without some highly critical post about Daily Kos. 

I did see this FEC story on Big Orange, and followed it on a few other blogs, and the feel I got from it is that the same type of complaint was made in 2004, and that there was no standing for it.  I don't read every blog, but of the ones I do read this only this site took that particular ball and ran with it as being highly critical of Daily Kos.  Mind you, I'm no expert in election law, and I don't pretend otherwise, but pursuing the line of reasoning I've seen here seems Quixotic at best.

Certainly y'all have a right to criticise Daily Kos, or Markos himself, or any other site.  I can tell you that I often just glace at the critical posts and pass them by--not because I won't tolerate criticism of Daily Kos or Markos himself (both deserve it, periodically) but because there is an animus towards both on this site, and I think that builds in some bias as far as what is written about them here.

Full disclosure: I joined dKos in 2004 and have stayed through everything, including the post-election aftermath in 2004, the "pie wars", and everything else.  I'm not uncritical of the site, but I am loyal to it.

Let's be real.  The diaries that have garnered the most criticism, all of it very deserving, are the defamatory ramblings of FLH.  And I, for one, ain't gonna stop criticizing those diaries or stop calling for that kind of abhorent speech from being condemned.

Pyrrho's FEC diary didn't garner a single critical comment from me, largely because I thought it added nothing of substance to the discussion -- something Pyrrho admits in the diary itself.

So, your using Pyrrho's FEC diary as a leaping off point to condemn those who are sick of FLH's defamatory diaries is unfair. 

If you want to countenance defamatory speech, that's your decision and it you can hardly expect people to forego commenting on that bad decision.

As for the issue of "transparency," you are wrong when you assert that "real businesses" disclose their financials every quarter -- only publicly traded companies do so.  The vast majority of businesses rightly keep their financials private. Markos is entitled to the same financial privacy as the rest of us, and there is no reason why he should be expected to disclose his salary, sources of income, bank statements, etc.  If he or his wife's parents helped him get a down payment for his house, as mine and many other people's parents did, what of it?  If he is obtaining income from add sales or a "tips" that are perfectly legal, what of it?

This is about a blog owner who fought tooth and nail against Russ Feingold's attempt to bring some transparency into blogging for hire; who flipped in a heartbeat from supporting Paul Hackett when a business associate was hired by Sherrod Brown; who states openly that his site is strictly for the advancement of Democrats, not issues... These are things that concern me and have for a long time. There needs to be some integrity to blogging for there to be any hope of it ever being seen as legitimate. Bloggers who could just as easily be working as publicists without disclosing that fact are rather like a newspaper publishing an advertorial on an editorial page without disclosing that it is, in fact, a paid advertisement. Remember Armstrong Williams? That's the kind of bullshit I'm talking about and have been talking about until I'm sick of fucking talking about it.

First and foremost, the content of the blog in question is not the question.  The question is in a blog's right to exist as they see fit.

Even if like me, you disagree with much of it, and their methodry; (yes a made up word I needed) its about their right to exist and function as they see fit.

To dispel that argument further, do you not think for a moment if Gore were to run, or any other truly powerful and committed leftist were to run, that My Left Wing would then become about electing that person 24/7?

Sure we would "allow" dissent, that would distract the majority, but that is purely Maryscott's choice, and does she not have a right to exist as she sees fit in blogtopia too?  Who has the right to determine her choices in a free internet?

Sure transparency in blogging would add legitimacy, but financial disclosure is not truly the question either.

This is from what I see an attempt to control content of bloggers and the sites they use.

They have already proven and made places like Murdoch's media untouchable.  The main threat to that?

BLOGGERS.

I for one do not wish to invite the Fed's into the bedrooms of the one house that opposes it most.  Citizen journalism and free blogging.

If the DNC pays most of dKos' bills and they find a paper trail of missives directing content, they may  be considered a PAC; this is unlikely.

Thing is, a challenge could be made to many Red sites that operate that way, but would they enforce it there?  Unlikely.

Just like the DOJ has been ordered NOT to enforce subpoenas for anyone in the Executive Branch.

These are strange times in which we live.

I wish NO PRECEDENT in which blogging's content or intent (subjective or explicit) is federally regulated.

If I had a blog to save trees, or to stop big business pollution, would that become a  PAC were it successful enough, or considered a lobby?

What AdamB, Moulitsas’ attorney, hopes to preserve is the status quo.  What IS the status quo?  The status quo is one in which DailyKos functions as a “noise machine” for the Democratic Party, or rather, for the right-wing “Reagan Democrat/DLC” element of the Democratic Party which Moulitsas wants to promote. 

Moulitsas wants to defend his prerogative to run off anyone who doesn’t fit his vision of a Democrat and to raise funds (in violation of federal campaign laws) as a political action committee without the accountability of a PAC.

It stinks.  His whole operation stinks like three day old fish.

The DFA blog does candidate advocacy all day, every day—but it doesn’t collect a bunch of money for ads, and therefore is allowed unlimited advocacy.  If Moulitsas is truly committed to Democrats winning, why doesn’t he eschew all those fat ad contracts and go the DFA route?  Hm, maybe because then he’d have to file federally required financial disclosure forms?  And he couldn’t make as much money as he does now.  Can’t have that, can we?

Quite simply put, this proposed FEC regulation would NOT affect MyLeftWing, even if MLW had paid advertisers, because MLW is an independent political blog, not a megaphone for the DLC element of the Democratic Party.

Let me reiterate so there’s no mistake:  Bambenek’s complaint only touches on the partisan blogs that want to function as political action committees WITHOUT public disclosure of their finances and WITH outside advertising.  This does NOT affect 98% of the political blogs out there—just Kos, his affiliated bloggers, and their counterparts on the Republican side of things.  Free speech isn’t the issue—in fact, speech isn’t free at all on DailyKos.  You have to pay for it, one way or the other.

These stories are childish and off-putting and boring and trivial, and they dilute the value of your commentary on other, non-Kos subjects.

It's as simple as that. You don't have to "shut up about it," since it's your site, and you can say whatever you want. But I won't listen to it anymore, as it's a counterproductive waste of my time to do so.

I've had sixty hits so far today at the "Truth About Kos" blog.  The ones I find most curious are the ones from RedState (a first).  I don't know why people are clicking in from Redstate, because I can't find any link at Redstate that is directing them to the "Truth About Kos."

People are also clicking in from a blog called "Little Green Footballs."

It's all happening because of links.  People are realizing that there is a blog with information about MAMZ that was never available before, and they are posting links to this information.

What I really wonder about is whether the national press will continue their fawning "rags to riches" coverage of YearlyKos, or whether they will realize and acknowledge in 2007 that MAMZ is actually from a wealthy and powerful Salvadoran oligarchy family, but has consistently denied it.

Will the MSM report MAMZ's CIA contacts this year?

I imagine that this year, when MSM reporters are writing about YearlyKos, they will come across so many new and interesting facts about MAMZ just by googling him that they will find it relatively boring and unenlightening to write the same old uninformed and unresearched stories that they wrote in previous years.

The real news about YearlyKos is the news about MAMZ himself.

When a blogger spends six months training at the CIA and then immediately his blog becomes very successfully financially, I don't think it's wrong to inquire whether the blogger received funding from the CIA.  And when that blogger says he "would have no problem" working for the CIA in the present, I believe that statement raises the issue of, "Does that blogger work for the CIA in the present or doesn't he."

The problem is that if a blogger does work for the CIA, it seems unlikely that he will acknowledge it any more than MAMZ already has. 

The CIA is famous for PsyOps or psychological operations.  If MAMZ didn't learn his rhetorical strategies during his six month's training (or "interviewing") at the CIA, then the CIA should take some pointers from him.

You point out one of these psy-ops rhetorical strategies:  Everyone who criticizes MAMZ is "bashing" MAMZ and all "bashing" of MAMZ is bad, therefore all criticism of MAMZ is bad.

Let me send a message to Kosdom tonight:  We're not all so stupid that we will accept such a proposition! We are not all so mentally addled that we will accept that the CIA ex-trainees among us must be forgiven AND are inherently above criticism. 

Compare Kos to Hillary Clinton, who MAMZ constantly criticizes:  Does Hillary Clinton claim that she is above criticism?  NO!  She accepts the criticism as a manifestation of the voters right to use their own minds, and then she goes about addressing the criticisms one by one, with changes in policy, procedure and emphasis, when warranted.  MAMZ, on the other hand, holds fast to the premise that he knows better than all of the rest of us and therefore he has an inherent right NEVER to be criticized ANYWHERE.

And he sends out his minions to stop people from expressing themselves, by advocating banning, and Republican strategies like shouting down the opposition (as the Republicans did during the recount in Florida in 2000).

It should surprise no one that a "progressive" activist who is an ex(?)Republican and trained for so long within Republican and CIA circles now relies so heavily on Republican pressure tactics. He joined our Party, but he never disavowed the strategies he learned when he was working for George H.W. Bush and Henry Hyde.

At MyLeftWing, there is consensus about at least one thing.  MAMZ's six months' training at the CIA do not mean that MAMZ is above criticism.  MAMZ will get the same respect here that everyone else gets.  We take him and his supporters' and his financiers' ideas seriously and so we discuss them critically. We support them when they advocate national health care, but we denounce them when they advocate censorship and when they would conduct themselves as if the First Amendment were nothing but dirty toilet paper.

Without going into too much detail, the type of "malice" you have to show depends upon the identity of the victim.  If the victim is a "public figure," as Kos is, then "actual malice" is required.  Actual malice is knowledge of the falsity of the statement or reckless disregard of whether or not it is false.  The venom that FLH shows towards Kos would not be sufficient to establish "actual malice," but it would be helpful in a defamation suit for a variety of other reasons.

My personal take on FLH is that so long as he's not posting his crap about Markos, he's not acting trollish.  I do believe that unpopular speech should be countenanced.  I don't believe that about defamation.  And if I had a site, I'd feel free to curate it to make it the best site possible.  I'd like to see MSOC tell him to knock off the repeated posting of information which is clearly false.  Exercising such an editorial function is well within her rights, and she does so already.

If all FLH is going to post are repetitions of the same false defamations, then, "Yes," you should ban him.  Their falsity has been demonstrated yet he persists. This a far different offense than what caused the misguided banning of me.

I've been researching the FEC regulations, and concluded that Adam B is wrong (6.50 / 4)
Adam B has stated that candidates couldn’t post on DailyKos if it’s classified as a PAC, because allowing them to post there would be an “in kind” contribution.

Not true. This only applies if people are charged to post diaries at DailyKos (or any other blog). If ANYBODY can post there, without charge, then there is no monetary value attached to the diary (or to the comment).

The $5,000 limit on PAC donations to individual candidates only applies if, for example, DailyKos was DONATING ads to candidates. But if DailyKos sells ads at market value, or allows people to post for free, then there is no “in kind” contribution of services and hence no limit.

The Idaho Secretary of State’s office actually summarizes this better than the FEC’s own website, although they essentially say the same thing:

How does "in-kind" contributions affect contribution limits?

An "in-kind" contribution shall be reported at its fair market value and counts toward any applicable contribution limit of the contributor.

One could imagine that discounts offered to particular candidates would be considered contributions, and that the rates so published would have to be honored for all but purely in-house ads (which would prevent them doing so for the separate YearlyKos).

I don't think I bash kos. I criticize the fall of dkos and did so all along the way, and even for those that disagree it's fallen, I have at least been consistent and I am fair.

I don't condemn kos though at this point to be honest I have to say I don't like him or the way he acts, and I feel he is bad for progressive politics... we are well into the "some steps backward" part of the forward and backward process.

I think kos represents a type of problem on our side... some people, FACTIONAL thinkers look at which faction it is with a problem, and if it's their own they say "better to spend time on the opposition's problem"... but they also say, "don't leave, change from within"...

problems in my house are a first priority, if those problems make it harder to solve the bigger problems outside.

The democrats have a problem that prevents them solving bigger problems, and Dean brought pressure to bear on "the Democratic Wing of the Democratic Party" and kos inherited a lot of that zeal... and defused it, pruned it into the most hideous topiary possible which might still pretend to be a liberal garden... ok.. ok... that's hyperbole, it's just really ugly, not "the most hideous".

I wish I could write on this topic, and you could just ignore it when I do... but if it's any consolation I too tire of it, and really, my job is done if people know that I am not on kos' boat, share none of his success with me as a blogger and none of his failure... he does not represent me, is not a leader in my eyes, no one to thank for peer to peer politics... and I want to be on record as one banned there for something I posted not at dkos NOR EVEN HERE, but something I PROMOTED here.  Remember that those kind souls with time to waste, and also let it be known well that Markos owes US thanks, the people in the diaries, the Deaniacs... for that energy would have created a dkos elsewhere if poor markos had not invented the internet (snide, yes).

If that's well known, even in the small locales of the blogistan, then I can move on.

I want to say "barring continual bad conventional wisdom and action" but that's not fair as I think it certain that shall happen, so lets say I could raise my standards quite high before feeling the need to comment, since I freely admit that markos is not really very important to politics in any real sense, any more than any other partisan hack.

I will never understand this need people have to passive aggressively silence those ideas that tweak them. But the impossibility of such coercion in a cyber environment would seem to me to be self-evident.

I don't doubt that should the day ever come wen you find yourself in the minority on an issue that's important to you and subsequently suffer the wrath of the flying monkeys, you will come to understand the position of those who "bash" DKos -- just a little more clearly than you do now.
