And I do *hate* doing surveys. But I did it to assuage my guilt for not really having much content to offer lately, here or anywhere else. And as far as the whole  DKos thing, I have a lot of thoughts, but none that I feel up to writing. I spend a lot of time thinking about the standard way that people interact with those who are different from them. Frankly, it's just getting me down. Every now and then I think I've got something worthwhile to say about the big picture, the "ultimate answer to life, the universe, and everything", as it were...but then I think better of it.

Besides, I really need to spend that time trying to generate income.

I think I'm whining again...sorry.

Will be going to water aerobics in about an hour. That usually helps some.

Lately hardly a day goes by on this site without some highly critical post about Daily Kos. 

I did see this FEC story on Big Orange, and followed it on a few other blogs, and the feel I got from it is that the same type of complaint was made in 2004, and that there was no standing for it.  I don't read every blog, but of the ones I do read this only this site took that particular ball and ran with it as being highly critical of Daily Kos.  Mind you, I'm no expert in election law, and I don't pretend otherwise, but pursuing the line of reasoning I've seen here seems Quixotic at best.

Certainly y'all have a right to criticise Daily Kos, or Markos himself, or any other site.  I can tell you that I often just glace at the critical posts and pass them by--not because I won't tolerate criticism of Daily Kos or Markos himself (both deserve it, periodically) but because there is an animus towards both on this site, and I think that builds in some bias as far as what is written about them here.

Full disclosure: I joined dKos in 2004 and have stayed through everything, including the post-election aftermath in 2004, the "pie wars", and everything else.  I'm not uncritical of the site, but I am loyal to it.

Sorry, this became a self righteous rant, and it's certainly directed at those in leadership, as part of it is at you Diane, but really so what if someone with better writing skills talks about the DOJ and the White House, it means nothing, all of our fury and scorn, if the Democrats don't do what's necessary to stop it, and nothing short of impeachment will stop it.

Let's be real.  The diaries that have garnered the most criticism, all of it very deserving, are the defamatory ramblings of FLH.  And I, for one, ain't gonna stop criticizing those diaries or stop calling for that kind of abhorent speech from being condemned.

Pyrrho's FEC diary didn't garner a single critical comment from me, largely because I thought it added nothing of substance to the discussion -- something Pyrrho admits in the diary itself.

So, your using Pyrrho's FEC diary as a leaping off point to condemn those who are sick of FLH's defamatory diaries is unfair. 

If you want to countenance defamatory speech, that's your decision and it you can hardly expect people to forego commenting on that bad decision.

As for the issue of "transparency," you are wrong when you assert that "real businesses" disclose their financials every quarter -- only publicly traded companies do so.  The vast majority of businesses rightly keep their financials private. Markos is entitled to the same financial privacy as the rest of us, and there is no reason why he should be expected to disclose his salary, sources of income, bank statements, etc.  If he or his wife's parents helped him get a down payment for his house, as mine and many other people's parents did, what of it?  If he is obtaining income from add sales or a "tips" that are perfectly legal, what of it?

related to a complaint by a virulent right wing blogger hoping to shut down Daily Kos.  Every single one of us should have seen this as a threat to all of us.  Instead, some people here lined up to support Bambeneck and his complaint.  Whatever you think of Kos, that's insane.

I, for one, recall some fundraising buttons right here on MLW last election cycle, and not a one was for a Republican.  Are we next?  Do we really want the FEC deciding who is just a blog and who is not?  Are people that desperate for governmental interference in this new media?  Or are they just blinded by orange hate?

Sorry MSOC, but the glee with which Bambeneck's complaint was greeted, and the nastiness to AdamB who, whatever else you might think of him, actually knows the law in this are, reflected incredibly poorly.

This is about a blog owner who fought tooth and nail against Russ Feingold's attempt to bring some transparency into blogging for hire; who flipped in a heartbeat from supporting Paul Hackett when a business associate was hired by Sherrod Brown; who states openly that his site is strictly for the advancement of Democrats, not issues... These are things that concern me and have for a long time. There needs to be some integrity to blogging for there to be any hope of it ever being seen as legitimate. Bloggers who could just as easily be working as publicists without disclosing that fact are rather like a newspaper publishing an advertorial on an editorial page without disclosing that it is, in fact, a paid advertisement. Remember Armstrong Williams? That's the kind of bullshit I'm talking about and have been talking about until I'm sick of fucking talking about it.

and it's one I've considered... a lot. But, yes, at the end of the day, I'm a fan of government regulation when it comes to monetary abuses. I'm for more regulation of corporate practices and when it comes to that toxic mixture of money and politics. And I just don't buy all the scare tactics -- and Markos whipped out plenty in his debate with Feingold -- about how it will infringe on free speech in the blogosphere. I want to know when what I read is a paid endorsement rather than one of conscience.

The guidelines here on ratings are pretty fucking clear per the Troll rating; if someone isn't a troll, don't troll rate the comment. Use the fuckign "1," that's why it's there. You can make your point and avoid fucking with a pretty simple request from the proprietor of the site.

as I said in a way buried comment at the end of that essay; really that is a wish and not a legal question.  As much as I got burned by the Orange, the repercussions could fuck us as well, should this pan out badly.

First and foremost, the content of the blog in question is not the question.  The question is in a blog's right to exist as they see fit.

Even if like me, you disagree with much of it, and their methodry; (yes a made up word I needed) its about their right to exist and function as they see fit.

To dispel that argument further, do you not think for a moment if Gore were to run, or any other truly powerful and committed leftist were to run, that My Left Wing would then become about electing that person 24/7?

Sure we would "allow" dissent, that would distract the majority, but that is purely Maryscott's choice, and does she not have a right to exist as she sees fit in blogtopia too?  Who has the right to determine her choices in a free internet?

Sure transparency in blogging would add legitimacy, but financial disclosure is not truly the question either.

This is from what I see an attempt to control content of bloggers and the sites they use.

They have already proven and made places like Murdoch's media untouchable.  The main threat to that?

BLOGGERS.

Beware what you wish for, you may get it.

I for one do not wish to invite the Fed's into the bedrooms of the one house that opposes it most.  Citizen journalism and free blogging.

If the DNC pays most of dKos' bills and they find a paper trail of missives directing content, they may  be considered a PAC; this is unlikely.

Thing is, a challenge could be made to many Red sites that operate that way, but would they enforce it there?  Unlikely.

Just like the DOJ has been ordered NOT to enforce subpoenas for anyone in the Executive Branch.

These are strange times in which we live.

I wish NO PRECEDENT in which blogging's content or intent (subjective or explicit) is federally regulated.

If I had a blog to save trees, or to stop big business pollution, would that become a  PAC were it successful enough, or considered a lobby?

Seriously, if you go to bed with snakes, you wake up bitten, and we already know these sons of bitches aren't on our side.

Not the side of Centrists, and not the side of Leftists.  They are on the side of the status quo.  Big Business and the Uberrich, and all the mechanisms that keep them unchecked in power.

There's blogs, and then there's blogs…and then there's DailyKos (4.50 / 2)

What AdamB, Moulitsas’ attorney, hopes to preserve is the status quo.  What IS the status quo?  The status quo is one in which DailyKos functions as a “noise machine” for the Democratic Party, or rather, for the right-wing “Reagan Democrat/DLC” element of the Democratic Party which Moulitsas wants to promote. 

Moulitsas wants to defend his prerogative to run off anyone who doesn’t fit his vision of a Democrat and to raise funds (in violation of federal campaign laws) as a political action committee without the accountability of a PAC.

It stinks.  His whole operation stinks like three day old fish.

The DFA blog does candidate advocacy all day, every day—but it doesn’t collect a bunch of money for ads, and therefore is allowed unlimited advocacy.  If Moulitsas is truly committed to Democrats winning, why doesn’t he eschew all those fat ad contracts and go the DFA route?  Hm, maybe because then he’d have to file federally required financial disclosure forms?  And he couldn’t make as much money as he does now.  Can’t have that, can we?

Quite simply put, this proposed FEC regulation would NOT affect MyLeftWing, even if MLW had paid advertisers, because MLW is an independent political blog, not a megaphone for the DLC element of the Democratic Party.

Let me reiterate so there’s no mistake:  Bambenek’s complaint only touches on the partisan blogs that want to function as political action committees WITHOUT public disclosure of their finances and WITH outside advertising.  This does NOT affect 98% of the political blogs out there—just Kos, his affiliated bloggers, and their counterparts on the Republican side of things.  Free speech isn’t the issue—in fact, speech isn’t free at all on DailyKos.  You have to pay for it, one way or the other.

I DON'T KNOW if Moulitsas gets a cut of the "tips" that people leave for ActBlue OR from the donations. In fact, I don't know DICK about any of it. And therein lies the rub of the criticism: nobody knows WHAT the fuck goes on over there, financially. I don't know if it should be legally required or not: I DO know it is ETHICAL to be transparent, and FISHY AS HELL NOT to be.

Transparent as a brick wall.  The only times I’ve seen Moulitsas or his helpers (paid and unpaid) truly go into a wasp-stinging frenzy is when somebody questions his financial dealings (despite his long-time association with known stock fraudster Jerome Armstrong).

Those who can't usually teach, but those who can neither do nor teach find themselves featured on political blogs like Daily Kos. My only hope is that followers of Kos like Hunter qualify for food stamps so that their children will not go to bed hungry.

Because it's tiresome, and it makes me not want to visit this site. You'll note by my user ID (#218) that I've been here from the beginning, and although I rarely post, I've probably come here an average of twice a day, every day, since day one. But I'm done now.

If it's to be a choice between Daily Kos and My Left Wing (and it appears that is the case), I choose Daily Kos. I'm looking for insightful political commentary, not petty drama. These stories are childish and off-putting and boring and trivial, and they dilute the value of your commentary on other, non-Kos subjects.

It's as simple as that. You don't have to "shut up about it," since it's your site, and you can say whatever you want. But I won't listen to it anymore, as it's a counterproductive waste of my time to do so.

Markos Moulitsas is one of the finest examples (8.60 / 10)

of humanity that I have ever witnessed.

Everybody has their favorite PastorDan moments, but mine was the diary he posted begging for money to help out a destitute woman get an operation. The good pastor refused to say what operation the woman needed, how much it would cost, or even where she lived (and certainly no details like her name)…in other words, he asked for lots of money with no accountability whatsoever…and lots of people sent it to him.

a UCC minister with a local church in Wisconsin. Has been there for several months.  He did not have a local pulpit for much of the last few years in Pennsylvania and while originally active on dKos, he does now. Not that that will change your mind, but thought I'd at least put a fact out. 

The UCC is congregationalist, in that each church calls their own pastor and employment is not assured by the denomination even if you're in good standing.

You most certainly are not. And please note, I have nothing bad to say about Pastor Dan or about Street Prophets. Pastor Dan was always kind to me until things got wretched and he had to choose; and he chose to be neutral, which, I guess, is as much as I could hope for from someone beholden to Moulitsas.

I'm getting a lot of hits at my "Truth About Kos" blog. (7.00 / 1)

I've had sixty hits so far today at the "Truth About Kos" blog.  The ones I find most curious are the ones from RedState (a first).  I don't know why people are clicking in from Redstate, because I can't find any link at Redstate that is directing them to the "Truth About Kos."

People are also clicking in from a blog called "Little Green Footballs."

It's all happening because of links.  People are realizing that there is a blog with information about MAMZ that was never available before, and they are posting links to this information.

What I really wonder about is whether the national press will continue their fawning "rags to riches" coverage of YearlyKos, or whether they will realize and acknowledge in 2007 that MAMZ is actually from a wealthy and powerful Salvadoran oligarchy family, but has consistently denied it.

Will the MSM report MAMZ's CIA contacts this year?

I imagine that this year, when MSM reporters are writing about YearlyKos, they will come across so many new and interesting facts about MAMZ just by googling him that they will find it relatively boring and unenlightening to write the same old uninformed and unresearched stories that they wrote in previous years.

The real news about YearlyKos is the news about MAMZ himself.

When a blogger spends six months training at the CIA and then immediately his blog becomes very successfully financially, I don't think it's wrong to inquire whether the blogger received funding from the CIA.  And when that blogger says he "would have no problem" working for the CIA in the present, I believe that statement raises the issue of, "Does that blogger work for the CIA in the present or doesn't he."

The problem is that if a blogger does work for the CIA, it seems unlikely that he will acknowledge it any more than MAMZ already has. 

The CIA is famous for PsyOps or psychological operations.  If MAMZ didn't learn his rhetorical strategies during his six month's training (or "interviewing") at the CIA, then the CIA should take some pointers from him.

You point out one of these psy-ops rhetorical strategies:  Everyone who criticizes MAMZ is "bashing" MAMZ and all "bashing" of MAMZ is bad, therefore all criticism of MAMZ is bad.

Let me send a message to Kosdom tonight:  We're not all so stupid that we will accept such a proposition! We are not all so mentally addled that we will accept that the CIA ex-trainees among us must be forgiven AND are inherently above criticism. 

Compare Kos to Hillary Clinton, who MAMZ constantly criticizes:  Does Hillary Clinton claim that she is above criticism?  NO!  She accepts the criticism as a manifestation of the voters right to use their own minds, and then she goes about addressing the criticisms one by one, with changes in policy, procedure and emphasis, when warranted.  MAMZ, on the other hand, holds fast to the premise that he knows better than all of the rest of us and therefore he has an inherent right NEVER to be criticized ANYWHERE.

And he sends out his minions to stop people from expressing themselves, by advocating banning, and Republican strategies like shouting down the opposition (as the Republicans did during the recount in Florida in 2000).

It should surprise no one that a "progressive" activist who is an ex(?)Republican and trained for so long within Republican and CIA circles now relies so heavily on Republican pressure tactics. He joined our Party, but he never disavowed the strategies he learned when he was working for George H.W. Bush and Henry Hyde.

At MyLeftWing, there is consensus about at least one thing.  MAMZ's six months' training at the CIA do not mean that MAMZ is above criticism.  MAMZ will get the same respect here that everyone else gets.  We take him and his supporters' and his financiers' ideas seriously and so we discuss them critically. We support them when they advocate national health care, but we denounce them when they advocate censorship and when they would conduct themselves as if the First Amendment were nothing but dirty toilet paper.

On the question of libel, my understanding from these discussions is that to demonstrate libel one must show malice on the part of the individual accused of libel.

Is that correct?

It is a question, therefore, on the state of mind of the accused, yes?

Now, what if it can be shown that the person accused of libel has made a statement that he or she gets emotional gratification from hurting the alleged target of the libel?

Would that be evidence to support malice and, therefore, libel?

Without going into too much detail, the type of "malice" you have to show depends upon the identity of the victim.  If the victim is a "public figure," as Kos is, then "actual malice" is required.  Actual malice is knowledge of the falsity of the statement or reckless disregard of whether or not it is false.  The venom that FLH shows towards Kos would not be sufficient to establish "actual malice," but it would be helpful in a defamation suit for a variety of other reasons.

I was previously burned by off-blog discussions, I prefer anonymity, and my opinions about this conduct are for public consumption.  If you want to look into "actual malice" further, I'd suggest reading NYT v. Sullivan.

My personal take on FLH is that so long as he's not posting his crap about Markos, he's not acting trollish.  I do believe that unpopular speech should be countenanced.  I don't believe that about defamation.  And if I had a site, I'd feel free to curate it to make it the best site possible.  I'd like to see MSOC tell him to knock off the repeated posting of information which is clearly false.  Exercising such an editorial function is well within her rights, and she does so already.

the thing is, "best site possible" is a lot like "best government possible"... democracies, free people, are chaotic.  The best situation would be if we could handle things without shutting people up, because there is always the personal method of shutting someone up, not listening.

On the net there are other ways... I mean FH's case is pretty played at this point, and certain aspects refuse to change, one could post a standard comment about the fact that kos has NOT ADMITTED to "training" or "working" for the CIA if one didn't want to leave it unanswered.  Of course, many things go unanswered, it's not as bad as it seems.

Free Speech isn't free, there are costs, but somewhere, even, my god, on private property, there should always be people trying to provide a place for free expression because it. is. important.

Thanks for trying to whip up a libel suit against Mr. Holland, which is what I assume you’re trying to do—I also assume Maryscott, as the MLW proprietor, would be included in it. 


It’s clear that there’s no lawsuit to be had here, yet what I’m witnessing is the appalling spectacle of you attempting to conspire—in public, yet—with Cityduck to make life more difficult for MyLeftWing and Maryscott.


You know something?  If you’re that fucking loyal to DailyKos, and feel so aggrieved by Mr. Holland’s frequent criticisms, please STOP conspiring against MyLeftWing in a frontpage diary and—at a minimum—have the decency (and intelligence) to do your conspiring in private.  Or just take yourself to DailyKos and stay there, because Mr. Holland has been BANNED at that blog and you won’t have to inflict his writing on your eyeballs.  Markos has an attorney—AdamB—and he reads MyLeftWing.  If he thought there was cause for a libel suit against Mr. Holland, he’d take care of it, wouldn’t he? 


Good on Cityduck for refusing to go “off blog” and join in the shitty scheme you’re trying to cook up.  As for what I think of YOU and the disrespectful way you are acting…well, you’re quite frankly not worth the time it would take me to type it.

But before I go you need to be corrected on something.

I was hatching no "scheme" against MSOC or MLW.

I simply was not.

I have a quote from Francis Holland which goes to his motivation for smearing Moulitsas.

This is the quote:

“But, when I read what's going on with my people in the United States, I still become furious and I want to do something about it. I think that's part of why punishing Markous Moulitsas is so therapeutic for me.”

I was curious to know what cityduck might think of this quote from a legal perspective, but also decided that a little discretion in this instance was warranted.

I have never had any intention whatsoever to in any way harm either MLW, nor MSOC.

You can choose not to believe me, but I know the truth.

In any case, I do find Holland's smear job of Moulitsas to be highly unethical.

Amd I am sorry to see this smear job taking place on MLW.

To MSOC and to Diane, I want to thank you for being so gracious to me during my brief period posting here.
